Amin v Amin

Divorce – Financial provision. The judge had jurisdiction to make a pension sharing order and to make supplemental orders by way of enforcement of his previous lump sum order, which had ordered the husband to pay the wife £350,000 and which the husband had failed to pay. The Court of Appeal, Civil Division, in dismissing the husband's appeal, held that the husband's attack on the judge's exercise of discretion in utilising part of the husband's pension fund by way of enforcement was hopeless. It had been perfectly proper for the judge to have proceeded as he had.
