Human rights – Right to liberty and security. The claimant Iraqi civilians were entitled to damages from the defendant Ministry of Defence for ill-treatment and unlawful detention by British armed forces. The Queen's Bench Division found that the claimants' claims in tort were time-barred, but it was equitable to permit the claims to be brought under the Human Rights Act 1998 for inhuman and degrading treatment, and unlawful detention, contrary to arts 3 and 5 of the European Convention on Human Rights.
