Alsaifi v Secretary of State for Education

Education – Teacher. The Administrative Court held that the defendant Secretary of State had no power to make a prohibition order against the appellant, as he had not been a person employed or engaged to carry out teaching work at an institution defined in s 141A of the Education Act 2002 at the time of alleged unprofessional conduct or the referral of the allegation, but had been at the time of the hearing before the panel and when the prohibition order had been made.
