European Union – Trade marks. Regarding an application for a declaration of invalidity against the intervener's registered European Union trade mark 'CALCILITE', in which the applicant had relied on an earlier registered EU word mark 'Calcilit', the General Court of the European Union held that the decision of the respondent Fourth Board of Appeal of the European Union Intellectual Property Office, that there had been no similarity between the specific goods in question, had been based on irrelevant and questionable considerations. Accordingly, the applicant's action would be upheld in part, however, the action would be dismissed as to the remainder.
