Employment – Wrongful dismissal. The Court of Appeal, Civil Division, dismissed the appellant employee's appeal against a finding that he had not been wrongfully dismissed for gross misconduct when he had failed to take sufficient action following the sending of an email by a staff member that threatened to compromise the results of an internal company survey. The court had been entitled to find that that had been a serious dereliction of duty, and that that failing constituted gross misconduct because it had the effect of undermining the trust and confidence in the employment relationship.
