Criminal evidence and procedure – Mutual corroboration – Judge's charge. High Court of Justiciary: Refusing an appeal by an appellant who was convicted of the rape of his partner and indecent behaviour towards one of his daughters, and acquitted of charges of rape of and indecent behaviour towards another daughter, the court rejected contentions that the differences between the circumstances of the charges of which the appellant was convicted were such that it could not be said that each was part of a single course of criminal conduct, and that the trial judge having directed the jury to only apply the rule of mutual corroboration between charges within a group of charges it was not open to the jury to apply the rule between charges belonging to different groups.
