Criminal law – Consumer protection. A commercial practice for the purposes of art 2(d) of Directive (EC) 2005/29 and reg 2(1) of the Consumer Protection from Unfair Trading Regulations 2008, SI 2008/1277, mighty be constituted by or derived from a test purchase made of a product (including a service) that was generally promoted to and intended for purchase by consumers, even where the purchaser might not himself be a consumer. Accordingly, the Divisional Court allowed the appellant trading standards authority's appeal by way of case stated against the judge's dismissal of an information against the respondent that it had engaged in a commercial practice which was a misleading action.
