Social security – Widowed parent's allowance. Section 39A of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 was incompatible with art 14, read with art 8, of the European Convention on Human Rights, in so far as it precluded any entitlement to widowed parent's allowance by a surviving unmarried partner of the deceased. Accordingly, the Supreme Court allowed the appellant's appeal against the Court of Appeal in Northern Ireland's decision, as it was not a proportionate means of achieving the legitimate aim of privileging marriage to deny the appellant and her children the benefit of the deceased's contributions because they had not been married.
