Indictment – Defective. The Court of Appeal, Criminal Division, heard together two cases raising the same ground of appeal against conviction, namely, that prosecution of the offences of which they were convicted had been time-barred. In determining whether errors in the two indictments had been errors of form or substance, the court found that in relation to one defendant, there had been a serious error of substance and the error had fundamentally undermined both the counts of which he had been convicted. However, in relation to the other defendant, the error had been one of form not substance.
