Sentence – Terrorism. Until the publication by the Sentencing Council of a guideline on terrorist offences, the Court of Appeal, Criminal Division, provided sentencing guidance relating to terrorism offences under s 5 of the Terrorism Act 2006. A six-level approach was adopted to enable a sentencing judge to identify where on the scale an offence would fall. Accordingly, the offender's sentence had been unduly lenient and two of the defendants' sentence appeals would be allowed.
