Prison – Prison conditions. Although there had been a failure to comply with the timetable laid down in the Parole Board Rules 2011, SI 2011/2947 in respect of the claimant, an indeterminate prisoner, the failure had not remained uncorrected so as to deprive the claimant of the reasonable opportunity which he ought to have had to challenge his tariff. The Court of Appeal accordingly set aside the contrary declaration of the High Court and the award of damages.
