Immigration – Detention. The claimant Moroccan national was entitled to £40,000 for his unlawful immigration detention, as there had been no reasonable prospect of his removal, in particular, given that there had previously been five unsuccessful attempts to obtain an emergency travel document. The Administrative Court further held that the claimant's remain in detention until suitable bail accommodation had been available did not deprive him of substantial, as opposed to nominal, damages.
