Trade union – Redundancy. By having cut the first claimant Public and Commercial Services Union out of the second round of discussions leading to amendments to the Civil Service Compensation Scheme, the defendant Minister for the Cabinet Office had acted in breach of the obligation of consultation with it contained in s 1(3), read with s 2(3D), of the Superannuation Act 1972. The Divisional Court further held that the Minister had failed to establish that the test for refusal of relief in s 31(2A) of the Senior Courts Act 1981 had been satisfied.
