The Supreme Court, in allowing the former police officer appellant's appeal against dismissal by the respondent Metropolitan Police Commissioner, held that the tribunal was not barred by the principle of judicial immunity, where the allegedly discriminatory conduct was that of persons conducting a misconduct hearing, namely the Police Appeals Tribunal, as had been so in the present case.
