Contract – Construction. Whether construed 'textually' or 'contextually', the 2007 agreement between the claimant NHS Commissioning Board and the defendant GP's, had meant that the sum specified for 'rent' in sch 7 of £77,238 was a fixed not a variable amount. If there had been a mistake on the part of the claimant in entering into such an agreement, it was not a mistake which, as a matter of construction, the court could or should correct. The Court of Appeal, Civil Division therefore dismissed the claimant's appeal in respect of overpayments made to the GP's pursuant to the 2007 agreement.
