The first claimant failed in his claim for delisting of personal information from Google's search engine, as he had failed to prove the information was inaccurate and Google's processing complied with the requirements of Google Spain SL and another v Agencia Española de Protección de Datos (AEPD) and another ([2014] 2 All ER (Comm) 301), and his claim for misuse of private information also failed. However, the Queen's Bench Division upheld the second claimant's claim, as some information was inaccurate, factors supporting continued accessibility were weak by comparison with those that weighed in favour of delisting and his misuse of private information claim also succeeded.
