Immigration – Asylum seeker. The Court of Appeal, Civil Division, dismissed the claimants' applications for judicial review of the defendant Secretary of State's decisions, certifying that their claims that their removal to Italy would be in breach of their human rights, in particular, art 3 of the European Convention on Human Rights, were clearly unfounded. The Secretary of State could return them to Italy without considering their human rights claims, on the basis that they had protection there or were entitled to claim it.
