Extradition – Conviction warrant. Section 2(5)(b) of the Extradition Act 2003 covered the situation of a requested person whose extradition was sought to face a hearing to decide whether (or not) to activate the custodial element of a past conditional sentence. Accordingly, the Divisional Court dismissed the appellant's appeal against orders for his extradition to the Czech Republic, as the European arrest warrant for his extradition to face a hearing to determine whether to activate an existing conditional suspended sentence was properly categorised as a conviction warrant.
