Immigration – Leave to remain. The Court of Appeal, Civil Division, dismissed the Secretary of State's appeal against the decision that evidence relied upon by it was insufficient to discharge the legal burden of proof that Test of English for International Communication (TOEIC) certificates had been procured by dishonesty. The present appeal was academic, but the Court entertained it as a test case in order for the Secretary of State to identify the various categories of other pending cases, so as to assist the Court with the proper management of those cases.
