Immigration – European Economic Area nationals. The actions of police officers, under Operation Nexus, in posing questions drafted by the Secretary of State did not breach art 14 of Directive (EC) 2004/38 of the European Parliament and Council. The Administrative Court further held that the posing of such questions by police officers did not make it unlawful when it would be lawful if done by a member of the public or an immigration and enforcement officer.
