The master had had no jurisdiction, under CPR 5.4C or the court's inherent jurisdiction, to allow a non-party to inspect a number of the categories of documents identified in her order. The Court of Appeal, Civil Division, in allowing the appellant's appeal, gave guidance on the documents which could be inspected and the discretionary test when determining whether access should be permitted, and rejected the challenges made to the exercise of the master's discretion.
