Employment and Discrimination Tribunal

The Employment and Discrimination Tribunal Panel is made up of independent lay people appointed under the law to hear and determine claims such as unfair dismissal and sex discrimination.

The Employment and Discrimination Tribunal is seeking Panel Members, including Side Members and Legally Qualified Chairs. Legally Qualified Chairs can hold the role for a five-year term, with the possibility of reappointment. This role requires candidates to commit approximately 15 days per year to fulfil this public duty.

The role of a Chairperson or a Side Panel Member at an employment tribunal is crucial in ensuring that cases are heard fairly, impartially, and efficiently. Here is a breakdown of their respective roles and responsibilities are detailed below:

Chairperson

1. Presiding Over Hearings: The Chairperson presides over tribunal hearings. They ensure that the proceedings are conducted in an orderly manner, following legal protocols and procedures.

2. Legal Guidance: The Chairperson provides legal direction and clarifies legal issues that may arise during the hearing. They ensure that the tribunal's decisions are based on correct legal principles.

3. Managing Evidence and Testimony: They oversee the presentation of evidence and testimony from both parties and ensure that all relevant information is considered and that the evidence is evaluated impartially. The Chairperson will also ask questions from both parties to clarify or to assist the parties as necessary.

4. Decision Making: In some cases, the Chairperson makes decisions alone, especially in straightforward or less complex cases.

5. Writing Judgments: The Chairperson is responsible for drafting the written judgment, which includes the tribunal's findings, legal reasoning, and any orders or awards. This document serves as the official record of the tribunal's decision.

Side Panel Members

1. Assisting the Chairperson: Two Side Panel Members assist the Chairperson during the tribunal hearings. They bring a lay perspective to the proceedings, complementing the legal expertise of the Chairperson.

2. Reviewing Evidence: Side Panel Members review the evidence and testimony presented during the hearing. They help ensure that the tribunal considers the broader context and practical aspects of employment issues. The panel members may also ask questions from both parties to clarify or to assist the parties as necessary.

3. Contributing to Deliberations: After hearing the evidence, Side Panel Members contribute to the tribunal's deliberations. They discuss the case with the Chairperson, providing their insights and opinions based on their experience and understanding of the workplace.

4. Decision Making: While the Chairperson has the primary responsibility for legal decisions, Side Panel Members participate in the decision-making process. Their views are considered when reaching a consensus or majority decision on the case.
