Murder changes

Changes to the law on murder, introduced by the Coroners and Justice Act 2009, have come into force.

The partial defence of “diminished responsibility” has been replaced by the concept of “an abnormality of mental functioning which arose from a recognised medical condition”. “Provocation” has been replaced by “loss of control”. The offence and defence of infanticide will now only be available for a woman who would otherwise be found guilty of murder or manslaughter, following amendments to the Infanticide Act 1938.
