Legal Services Commission recoupment of civil legal aid payments on account

All barristers who have at some point received payments on account for civil work from the Legal Services Commission will know that the LSC has the right to recoup any overpayments which become apparent on final taxation and assesment. 

They should be aware of the judgment of HHJ Anthony Thornton QC in LSC v Aisha Henthorn, 2010 [EWHC] 3329 (OBD) on 4 February 2011 as regards recoupment in old cases.  The LSC is appealing the decision.  The Bar Council is taking a close interest in the appeal and hopes to intervene.
