Court of Session: Refusing a petition seeking judicial review of a decision by Moray Council that outstanding planning conditions attached to a grant of planning permission for the construction of a large wind farm had been purified, the court held that the development had commenced within 5 years, as required by one of the conditions, and the petitioner had not brought proceedings within 3 months of the date on which the grounds of challenge first arose, as required for judicial review.
