In circumstances where divorce proceedings were ongoing in Scotland, but neither party had made a claim for financial provision within those Scottish proceeding, the wife was entitled to bring proceedings in England, under s 27 of the Matrimonial Causes Act 1973, seeking an order for maintenance for herself. The Court of Appeal, Civil Division, in dismissing the husband's appeal, held that the potential for the wife to make an application for maintenance in the Scottish divorce proceedings sometime in the future could not be sufficient to seise the Scottish court of the question of maintenance.
