Landlord and tenant – Forfeiture of lease. In possession proceedings, arising from the second defendant tenant's criminal conviction for conspiracy to supply class A drugs, the claimant landlords had failed, on the balance of probabilities, to prove facts amounting to illegal use of the premises in breach of a covenant in the lease. In so holding, the County Court also considered relief from forfeiture pursuant to s 146(2) of the Law of Property Act 1925, as well as a number of other alleged breaches of covenant.
