The powers and privileges of regalities, such as the power to create new baronies, had been abolished by the Heritable Jurisdictions (Scotland) Act and s 1 of that Act had not been rendered void by the Act of Union 1707. Accordingly, the Chancery Division dismissed the applicant's claim for relief, alleging that the respondent Official Receiver should have taken action in relation to his extensive regality rights, including the right to create titles of hour, to grant arms, admiralty and an exemption on duties, which had vested in the Official Receiver when administering his estate in bankruptcy.
