Public Prosecutor's Office of the Appeal Court of Eastern Crete, Greece v Andrew

Extradition – Discharge. The appellant judicial authority's failure to serve the respondent with notification of an appeal within the mandatory period, as relevant emails had not been received in her solicitor's secure email inbox, was fatal to the court's jurisdiction to entertain its appeal. Accordingly, the Divisional Court dismissed the judicial authority's appeal against the discharge of the respondent from extradition to Greece to serve the balance of a five-year sentence imposed for infanticide.
