Civil legal aid – Grant of legal aid – Fairness of application procedure. Court of Session: Granting a reclaiming motion in a petition in which local authority petitioners sought to reduce the Scottish Legal Aid Board's decisions to award the interested party legal aid to appeal against the dismissal of judicial review petitions challenging the petitioners' decisions concerning the care of his mother, and the Lord Ordinary granted the prayer of petition and reduced the Board's decisions, the court concluded that the Lord Ordinary had erred in holding that the Board had acted unfairly towards the petitioners in determining the interested party's legal aid applications.
