Extradition – Right to liberty and security. The present proceedings, concerning the appellant's extradition to the United States to stand trial for sexual offences, were not an abuse of process following the failure of earlier extradition proceedings. The Divisional Court, in dismissing the appellant's appeal against the judge's decision to send his case to the Secretary of State to decide whether he should be extradited, further held that nothing supported the proposition that the appellant would be subjected to any other process, particularly civil commitment, which would jeopardise his rights under art 5 of the European Convention on Human Rights.
