The judge had not erred in holding that whether the failure to comply with reg 4 of the Conditional Fee Agreements Regulations 2000, SI 2000/692, rendered conditional fee agreement conditional fee agreement unenforceable, as found, was also illegal, did not affect the claimant's claim against the defendant for breach of contract which was to be determined on the facts of the date of the alleged breach. Accordingly, the Court of Appeal, Civil Division, dismissed the defendant's appeal.
