Divorce – Financial provision. The respondent husband's non-payment of a legal services payment order arising from divorce proceedings, was an insuperable impediment to the course of justice. Accordingly, the Court of Appeal, Civil Division, allowed the wife's application for a Hadkinson order preventing the husband from pursuing an appeal in relation to the divorce proceedings. That order was subject to a condition that the husband be permitted to pursue his appeal, on payment of the sums outstanding under the legal services payment order, together with the wife's costs of the current application.
