Insurance – Disclosure. The claimant company's claim for negligence against the defendant insurance company succeeded only in regard to one of a number of claims. The Commercial Court held that the non-disclosure on the part of the company that had assigned the relevant rights to it had given two insurance companies a good defence to the majority of the claims under its policy. The claimant was entitled to recover damages in the value of the plant and machinery, namely £1,600,000.
