The inspector had understood the relevant policies and guidance correctly, and had applied them lawfully in assessing the likely effects of development on the setting of each heritage asset. The Court of Appeal, Civil Division, in allowing the second defendant's appeal, further held that the inspector's conclusions and findings revealed no error of law and did not suggest that he had misunderstood the concept of the setting of a heritage asset.
