Documents and interviews had been brought into being by the first defendant Royal Bank of Scotland and its litigation solicitors for the sole, or at least the dominant, purpose of the expected litigation following the expected assessment in respect of over claimed input VAT. Therefore, the Chancery Division held that the documents and interviews were covered by litigation privilege.
