The arguments raised by Austria in support of its action for annulment of Commission Decision (EU) 2015/658 (on the aid measure which the UK was planning to implement for support to the Hinckley Point C nuclear power station) would be rejected. The Commission had correctly found that such state aid was compatible with the internal market within the meaning of art 107(3)(c) of the Treaty on the Functioning of the European Union and had authorised its implementation. Consequently, the Court of Justice of the European Union dismissed Austria's action.
