The judge had been right to hold that the arrangement of appointments for the claimants at the defendant Spanish lawyers' offices had constituted the acceptance of offers, such that the lawyers had been engaged to act on the claimants' behalf before payment of the final instalment of the purchase price of holiday homes to which they had not received good title. Accordingly, the Court of Appeal, Civil Division, dismissed the lawyers' appeal against the judge's order for damages for professional negligence failing to advise the claimants of the risks of paying the final instalment without securing good title.
