Boundary – Party wall. The appellants' appeal against a decision in a property dispute succeeded. The Chancery Division held that, on the true construction of a transfer, a wall adjoining two properties in London was not to be considered a party wall, within the meaning of s 38(1) of the Law of Property Act 1925 and s 20 of the Party Wall etc Act 1996.
