Wallett (on her own behalf and on behalf of the dependants of Ian Hill (deceased)) v Vickers

Negligence – Road accident. In a claim for damages under the Fatal Accidents Act 1976, following a road traffic accident where the claimant's partner had been killed when trying to outrace the defendant driver, the Recorder had erred in dismissing the claim on the basis of ex turpi causa. Accordingly, the Queen's Bench Division allowed the claimant's appeal, and made an award to the claimant of £86,000.
