Vicarious liability – Employer and employee. The defendant Barclays Bank was vicariously liable for any assaults that any of the 126 claimants might prove to have been perpetrated by a doctor in the course of medical examinations carried out at the bank's request either before or during their employment with the bank. The Queen's Bench Division made that decision on the basis that the two-stage test as to whether or not vicarious liability existed had been met.
