Sowden v Smyth-Tyrrell and another

Arbitration – Award. The claimant tenant's challenges to the findings of an arbitrator in a land dispute were dismissed. A notice requiring him to remove a concrete path on the land had been valid, and there had been no irregularity in the arbitrator's award. Further, the arbitrator had not failed to deal with the tenant's argument on waiver and acquiescence.
