Arbitration – Award. The Commercial Court allowed the claimant company's application for a relief and a declaration that an arbitral tribunal had not been constituted properly and its award had been made without jurisdiction, where an individual purporting to act on the claimant's behalf had not actually been employed by the claimant, despite representing that he had been. The court held that, among other things, the claimant had not ratified the arbitration award either silently or positively.
