Immigration – Deportation. The First-tier Tribunal (Immigration and Asylum Chamber) had not applied the correct test or asked the appropriate questions in allowing the respondent Pakistani national's appeal against a deportation order and those errors were clearly material. The Court of Appeal, Civil Division, in allowing the Secretary of State's appeal, held that the Upper Tribunal (Immigration and Asylum Chamber) had also erred in its approach in upholding that decision.
