Tort – Conspiracy. The defendant pharmaceutical companies' application to strike out parts of the particulars of claim succeeded, in proceedings concerning, among other things, an unlawful means claim in relation to the sale of a drug used in the treatment of hypertension and cardiac insufficiency. The court held that, on the proper interpretation of the case law, especially its emphasis on the need to confine the tort within careful limits, the parts of the particulars of claim that related to that claim would be struck out.
