Practice – Family proceedings. The Family Division held that a re-hearing of a fact-finding hearing concerning injuries to a child would go ahead, even though the child's parents, who had applied to have the re-hearing, had stated that they no longer wanted it to take place. Subject to qualifications, the court was reasonably confident that the essential fairness and validity of the process would not be compromised by their absence of the parents from the re-hearing.
