Family proceedings – Hearing. The Court of Appeal, Civil Division, reversed a case management decision regarding orders made about a child following several aborted attempts to hold a fact-finding hearing over a number of years. The underlying welfare analysis necessitated determination of the truth behind several allegations made by the mother of the child, against the father of the child, in order to resolve the father's application for contact. Consequently, the judge had been incorrect to order that it was no longer necessary, or proportionate, for that hearing to take place.
