European Union – European arrest warrant. Article 3(3) of Council Framework Decision 2002/584/JHA was to be interpreted as meaning that the executing judicial authority should refuse to surrender only those minors who were the subject of a European arrest warrant and who, under the law of the executing member state, had not yet reached the age at which they were regarded as criminally responsible for the acts on which the warrant issued against them was based. The Court of Justice of the European Union so held, among other things, in a preliminary ruling in proceedings in Belgium for the execution of an EAW issued by a court in Poland.
