Company – Breach of fiduciary duties. A company which ran a hairdressing business brought proceedings against the appellant, alleging that she had misappropriated the business, in breach of fiduciary duties. The dispute arose following the breakdown of the appellant's relationship with the second respondent, the company's sole director and shareholder. The Chancery Division dismissed the appellant's appeal against a County Court judge's order striking out her defence and counterclaim. However, the court allowed her appeal against the striking out of her third party claim against the second respondent, as well as in respect of part of the judge's order requiring her to pay the company £44,041 for equipment and fittings allegedly misappropriated from the business.
