Jury – Verdict. The Court of Appeal, Criminal Division, in dismissing the defendant's appeal against conviction, held that the jury's verdict had not met the test for inconsistent verdicts under R v Fanning; R v Kerner; R v Osianikovas and another; and another case[2016] All ER (D) 39 (May). Although the prosecution had put its case in a particular way, by linking some of the offences together, that had not been determinative of the matter. In the present case, it had been open to the jury to convict on the counts separately.
